General Terms and Conditions

§ 1 Scope of application
(1) These General Terms and Conditions (hereinafter “GTC”) of IB Media GmbH, Rudolf-Wild-Straße 84, 69214 Eppelheim, Germany (hereinafter “we” or “Seller”) apply to all contracts concluded by a consumer (Section 13 of the German Civil Code, BGB) with us via the online shop Longevity Health Club at www.longevity-health-club.de.
(2) A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed professional activity. The shop is aimed exclusively at consumers; the conclusion of contracts with entrepreneurs within the meaning of Section 14 BGB is excluded.
§ 2 Conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to the customer to order goods (invitatio ad offerendum). (2) By clicking the button “Order with obligation to pay”, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart. (3) We confirm receipt of the order without undue delay by email (order confirmation). This order confirmation does not constitute acceptance of the offer unless acceptance is declared therein at the same time. (4) The contract is concluded when we accept the offer within 5 days by means of a separate confirmation of order by email or dispatch the ordered goods to the customer within this period.
§ 3 Right of withdrawal
Consumers have a statutory right of withdrawal. Details are set out in our separate Instructions on Withdrawal.
§ 4 Prices and terms of payment
(1) The prices stated are final prices and include statutory VAT. Any additional delivery and shipping costs are indicated separately on the product page or at the latest during checkout. (2) Payment is made, at the customer's choice, using one of the payment methods offered and indicated during checkout. (3) In the case of payment in advance, the purchase price is due immediately upon conclusion of the contract. For other payment methods, the purchase price is due at the time communicated by the respective payment service provider.
§ 5 Delivery, shipping
(1) Delivery is made to the delivery address specified by the customer, unless otherwise agreed. (2) Shipping costs are transparently indicated before completion of the order. (3) If we are not responsible for the unavailability of the goods (reservation of self-supply), we are entitled to withdraw from the contract. In this case, we will inform the customer without undue delay and refund any payments already made without undue delay. (4) Expected delivery times are indicated during the ordering process or on the respective product page.
§ 6 Retention of title
The delivered goods remain our property until full payment has been made.
§ 7 Transport damage
If goods are delivered with obvious transport damage, the customer is asked to report the damage to the delivery service and to inform us thereof. Failure to make a complaint or to contact us has no effect whatsoever on statutory claims and their enforcement, in particular warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.
§ 8 Warranty
The statutory law on liability for defects applies (liability for material defects, two-year limitation period from delivery). Information on any additional manufacturer warranties and their exact conditions can be found with the respective product.
§ 9 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Final provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection afforded by mandatory provisions of the law of the state in which the consumer has their habitual residence. (2) Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
